While we are certainly appreciative of your efforts to keep us advised of the <br />current situation with respect to San Joaquin County�is requirements and your proposed <br />response, I must again point out to you that in accordance with the lease dated December <br />1, 1984, this company as Lessee bears no responsibility for any actions the County may <br />require in response to the 1986 tank test failure or any investigation or remediation related <br />to that failure. <br />i, <br />As you are well aware, our letter agreement dated;'IJanuary 31, 1992 specifically <br />limited Ultramar's contribution to "payment of one half of :!Consultant's fees incurred by <br />Landowner for the First Quarter quarterly monitoring `and reporting due January 31, 1992, <br />which shall not exceed $2,000." Further, paragraphap4 of the Letter Agreement dated <br />January 31, 1992 states, "...except to the extent that [Ultramar] has agreed to reimburse <br />Landowner for the costs of such work, [Ultramar] as no responsibility or liability <br />either to PHSIEHD or Landowner for such work "!'nor for any subsequent required <br />monitoring, reporting, or remediation at the site." [emphasis mine]. <br />.r <br />To date, we have met our obligations under the letter agreement and intend to <br />meet any remaining obligations thereunder.
