Box 2009 <br />Stockton, CA 95201 <br />Dear Ms. Meays: <br />Telecopy: 209-584-6113 Credit & Wholesale <br />2o9-583-3330 Administrative <br />209-583-3302 Information Services <br />209-583-3358 Accounting <br />August 6, 1.992 Eft soft V ift <br />AUU 10�� <br />I NVIRONIVI -NTA, FJEALT�j <br />PERMITi5eNV1CL8 <br />Re: 3300 Waterloo Road <br />Stockton, CA <br />Pursuant to your letter dated July 16, 1992, to Mr. Quentin Kirsch and Mr. Glenn <br />Dembroff of this Company, and our recent telephone conversation, enclosed please find <br />a copy of our Lease Agreement ("Lease") which governs our lease of the property and <br />underground facilities located at 3300 Waterloo Road, Stockton, California ('Property"). <br />As I explained to you during our conversation, we do not believe that we are responsible <br />for the present environmental condition of the property, and the. further assessment and <br />possible remediation activities which San Joaquin County ("County") is requiring to be <br />performed. <br />As you may already know, our involvement with the Property is pursuant to our <br />Lease dated December 1, 1984, with the Property owners, Mr. Quentin Kirsch and Ms. <br />Claire Kirsch ("Kirschs"). Since the commencement of our Lease, we have operated a <br />commercial fueling facility and are unaware of any unauthorized subsurface releases of <br />petroleum product resulting from our operations. In 1986, however, a tank test failure <br />occurred which resulted in the Kirschs lining the tanks and installing monitoring wells in <br />accordance with their responsibility for the underground facilities under our Lease. <br />Specifically, Section X of our Lease expressly states, in pertinent part, that: <br />"Lessee shall not be responsible for any cost, damages, <br />expenses, fines or fees resulting from any leaks from the <br />underground facilities or contamination of the soil or <br />groundwater nor shall Lessee be responsible for any repairs <br />to the underground facilities...". <br />1WP511ENVRNMNT10010W.LTR <br />07.05.09 <br />A Member of the Ultramar Group of Companies <br />BAC® <br />#1 Quality and Service <br />
