The facility's business plan was not submitted electronically to the California Environmental Reporting System (CERS)for 2018, 2019, and 2020. As of January 1, 2013, all businesses were required to submit all business plans electronically. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 3 HSC 25507 Failed to establish and implement a hazardous materials business plan. A Hazardous Materials Business Plan has not been established or implemented for 2018, 2019, and 2020. A Hazardous Materials Business Plan shall be established and implemented for emergency response to a release or threatened release of a hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for materials that are liquids, 500 pounds for solids, or 200 cubic feet for compressed gas, at standard temperature and pressure. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD. This is a Class II violation. 4 HSC 25508(a)(1) Failed to complete and/or submit the Business Activities or Owner/Operator Identification page. The Business Activities form was not accurate and wrongly indicates the business does not have reportable amounts of hazardous materials and hazardous waste. This information must be current and submitted as part of the business plan. Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 5 HSC 25505(a)(1) Failed to complete and/or submit hazardous materials inventory for all reportable materials on site. At least 781 gallons of new oil, one 1,000 gallon waste oil tank, seven drums of waste oil/fuel filters(amount greater than 500 pounds; actual weight was not available), four 55 gallon drums of aluminum brightener, three 55 gallon drums of detergent, and one 282 cubic foot compressed oxygen cylinder were found onsite and have not been reported . Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan.
