POLICY <br /> California Department of Corrections and Rehabilitation (CDCR) and California <br /> Correctional Health Care Services (CCHCS ) shall safeguard the health and safety of its <br /> employees and patients by maintaining a system of internal control over the medical waste <br /> management process within CDCR institutions to ensure compliance with requirements <br /> under federal and state laws and regulations regarding medical waste containment, storage, <br /> disposal , and proper oversight of the Medical Waste Management Plan/Regulated Waste <br /> Local Operating Procedure. Waste generated by CDCR and CCHCS includes waste <br /> identified within both the Federal Resource Conservation and Recovery Act (RCRA) and the <br /> California Medical Waste Management Act . <br /> II . PURPOSE <br /> To provide consistent management of waste generated by health care staff and to ensure <br /> CDCR and CCHCS compliance with federal , state and local requirements for safety and <br /> proper handling. <br /> III . DEFINITIONS <br /> California Medical Waste Management Act : The statute that governs the disposal of <br /> biohazardous waste, sharps containers , pharmaceutical waste exempt from Resource <br /> Conservation and Recovery Act (RCRA) , trace chemotherapy waste, and pathology waste . <br /> Medical Waste : Waste produced as a result of the delivery of health care that is regulated by <br /> the California Medical Waste Management Act (MWMA) including biohazardous , <br /> pathology, pharmaceutical , or trace chemotherapy waste that is not regulated by RCRA; <br /> sharps and trace chemotherapy waste generated as part of diagnosis , treatment , <br /> immunizations , or care of humans . <br /> Medical Waste Management Plan : A document required by the MWMA specific to a <br /> single generator which defines the generator ' s processes for the disposal of the medical waste <br /> that it generates . <br /> Resource Conservation and Recovery Act : The principal federal law governing the <br /> disposal of hazardous waste . <br /> RCRA Hazardous Waste : Waste regulated by the RCRA whose properties make it <br /> potentially dangerous or harmful to human health or the environment by exhibiting one of the <br /> four characteristics of hazardous waste (ignitability, corrosivity, reactivity, or toxicity) or is a <br /> specifically listed D , P , or U waste .
