SAN _J O A Q U I N Environmental Health Department <br /> -COU NTY- <br /> Underground Storage Tank Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> ESCALON MINI MART 1 1097 YOSEMITE AVE, ESCALON December 18, 2018 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 320 CCR 2635, 2637.2, 2665, 2712 Failure to comply with the installation, inspection, or record keeping of the overfill <br /> prevention. <br /> Owners or operators of underground storage tanks that do not meet California Code of regulations,title 23 division <br /> 3, chapter 16 section 2635(c)(2)shall test overfill prevention equipment once by October 13th, 2018 and every 36 <br /> months thereafter; and within 30 days of the date of a repair.The site did not performed the testing by October 13th, <br /> 2018 however the service technician on site was able to conduct the overfill prevention equipment inspection on <br /> 12/18/18 while the inspector was on site. Ensure to conduct overfill prevention equipment inspection within the time <br /> frame provided by the regulation and submit test results within 30 days of performing the inspection. Ensure a 48 <br /> hour notification is provided to EHD prior to conducting the inspection. <br /> This is a Class II violation. <br /> 326 HSC 25299(a)(9)Tampered with or disabled leak detection devices or alarms. <br /> When the inspector arrived on site on 12/18/18 to witness inside the submersible turbine sumps and under <br /> dispenser containment sumps.The inspector observed the following: <br /> Inside 87 product submersible turbine sump approximately 1-2 gallons of liquid on the side of the saddle of the tank. <br /> A ULS leak detector sensor was raised and tied around the fiberglass pipe 3-4 inches above the liquid.When the <br /> operator was asked why the sensor was raised and tied around the pipe, he responded that a person named Daine <br /> who is not a regular worker, cleaned up on 12/17/18 in the afternoon.When he was asked who opened the 87 <br /> product sump he stated that he opened up for Daine, (operator was not able to provide a last name)however he <br /> stated that he did not close the sump. Operator also stated that he did not know who raised and tied the sensor. <br /> After reviewing the alarm history for the site.The 87 STP sensor has had alarms on 2/2/18, 2/28/18, 4/18/18, <br /> 5/21/18,6/19/18, 7/15/18, 7/26/18, 12/14/18, and 12/15/18. <br /> The service technician who was on site at the time, stated that he had not touch the sensor before the inspector got <br /> there and that he would place the sensor back in the right location after he tested the sensor. <br /> Based on section 2990(a)9"An operator of an underground tank system is liable for a civil penalty of not less than <br /> five hundred dollars($500)or more than five thousand dollars($5,000)for each underground storage tank,for each <br /> day of violation, for any of the following violations: <br /> 9-Tampering with or otherwise disabling automatic leak detection devices or alarms." <br /> Immediately stop tampering with or otherwise disabling automatic leak detection devices or alarms. <br /> This is a Class I violation. <br /> Overall Inspection Comments: <br /> An inspection checklist was provided to the facility operator on the day of inspection. The EHD has written the <br /> complete report which replaces the initial checklist. <br /> Document reviewed: Monitoring system certification test results from 2016, 2017, Secondary containment 2015, <br /> employee training, response plan, maintenance records, monitoring plan, financial responsibility documents and <br /> designated operator monthly inspection reports from December 2018- November 2018. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, within 30 days of receiving the complete inspection report. <br /> FA0000279 PR0231497 SCO01 12/18/2018 <br /> EHD 23-01 Rev.09/28/2018 Page 7 of 8 Underground Storage Tank Program OR <br /> 1868 E.
