The following is an itemized list of hazardous waste violations that have not been <br /> addressed for A & D AUTO BODY as of March01, 2019 . <br /> Open violations from January 14, 2019 inspection <br /> Violation #101 - Managed a hazardous waste without an identification number. <br /> This facility does not have a valid ID number to manage hazardous waste . CAL000397547 is currently inactive . A <br /> hazardous waste generator shall not treat, store , dispose of, transport or offer for transportation , hazardous waste <br /> without an ID number. If you or your business generates more than 100 kg of RCRA hazardous waste and/or more <br /> than one kg of acutely hazardous waste , then you need to obtain an EPA ID number. All others must obtain a State <br /> ID number . Go to the DTSC web site http : //www. dtsc. ca . gov/IDManifest/ PERMHWID. cfm for the form to apply for <br /> an ID number. Immediately obtain an ID number to manage hazardous waste and submit evidence to the EHD . <br /> Violation #102 - Failed to determine if a waste is a hazardous waste . <br /> Paint dust generated from sanding vehicles is accumulated on the ground inside the shop . The paint dust is swept <br /> up and thrown in the garbage per the owner without first determining hazardous properties of the paint dust. Any <br /> person who generates a waste shall determine if the waste is a hazardous waste . Immediately make a hazardous <br /> waste determination for the paint dust, and manage it according the Title 22 hazardous waste regulations . Submit a <br /> statement and supporting documentation explaining how this waste was managed . <br /> Violation #119 - Failed to report program data in the California Environmental Reporting System ( CERS ) . <br /> A submission to the California Electronic Reporting System (CERS ) for the hazardous waste program has not been <br /> made. Beginning January 1 , 2013 , all businesses are required to submit all new (or any changes to existing ) <br /> hazardous waste information online to the CERS at http : //cers . calepa . ca . gov . Be sure to include your hazardous <br /> waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required <br /> fields . <br /> Violation #120 - Failed to submit a certification and written response within 30 days for minor violations . <br /> An inspection was last done on May 28 , 2015 and an inspection report was issued identifying information to be <br /> submitted to bring this site into compliance . This information was required to be submitted by June 28 , 2015 . This <br /> information has not been received resulting in a non-compliant status for this facility . An operator that receives an <br /> inspection report shall have 30 days to submit a written response that includes a statement documenting corrective <br /> actions taken or proposing corrective actions which will be taken . Ensure that a written response documenting <br /> corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. <br /> Open violations : <br /> - Failed to determine is a waste is a hazardous waste. <br /> - Failed to report program data electronically. <br /> -Stored hazardous waste on site greater than 180 days . <br /> Violation #601 - Stored hazardous waste onsite greater than 180 days . <br /> One blue metal 55 gallon drum of used oil was observed on the east side of the shop with an accumulation start <br /> date of November 2013 . Facilities who generate less than 1000 kg of hazardous waste per month and do not <br /> exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days . Immediately contact a <br /> licensed hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the <br /> EHD . <br /> Open violations from May 28 , 2015 inspection <br /> Violation #102 - Failed to determine if a waste is a hazardous waste or retain waste analysis on site for 3 <br /> years . <br /> Metal fines and paint dust generated from sanding vehicles in preparation for painting are being allowed to <br /> accumulate inside the shop and outside the shop on the parking lot without first determining metal particle size or <br /> hazardous properties of the metal and paint dust waste . Any person who generates a waste shall determine if the <br /> waste is a hazardous waste . Immediately stop allowing paint and metal fines waste to leave the auto body shop , <br /> make a hazardous waste determination for these wastes , and manage it according to Title 22 hazardous waste <br /> regulations . Metal particles 100 microns or smaller must be handled as hazardous waste if the metal is determined <br /> to be a hazardous waste . Submit a statement and supporting documentation explaining how these wastes were <br /> managed . <br /> Page 1 of 2 <br />
