SHAWN COUNTY- <br /> Small <br /> Environmental Health Department <br /> --COU NTY- <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> MCLANE FOODSERVICE DISTRIBUTION 800 PESCADERO AVE.TRACY September 23, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 713 CCR 66273.35 UWH stored UW onsite greater than one year or was unable to demonstrate storage time. <br /> OBSERVATION: The facility could not demonstrate that universal waste(UW) has been stored on site for no longer <br /> than one year. The following UW was stored on-site: <br /> 1.A 55 gallon black steel drum storing universal waste aerosol cans located in the forklift maintenance area was <br /> observed with an accumulation start date of 3/20/2018. <br /> REGULATION GUIDANCE: <br /> (a)A universal waste handler shall accumulate universal waste for no longer than one year from the date the <br /> universal waste was generated, or was received from another universal waste handler. <br /> (b)A universal waste handler shall be able to demonstrate the length of time that the universal waste has been <br /> accumulated from the date it became a waste or was received.The universal waste handler may make this <br /> demonstration by: <br /> (1)Placing the universal waste in a container and marking or labeling the container with the earliest date that any <br /> universal waste in the container became a waste or was received; <br /> (2)Marking or labeling the individual item of universal waste(e.g., each battery or thermostat)with the date it <br /> became a waste or was received; <br /> (3)Maintaining an inventory system onsite that identifies the date the universal waste being accumulated became a <br /> waste or was received; <br /> (4)Maintaining an inventory system onsite that identifies the earliest date that any universal waste in a group of <br /> items of universal waste or a group of containers of universal waste became a waste or was received; <br /> (5)Placing the universal waste in a specific accumulation area and marking or labeling the area to identify the <br /> earliest date that any universal waste in the area became a waste or was received; or <br /> (6)Any other method which clearly demonstrates the length of time that the universal waste has been accumulated <br /> from the date it became a waste or was received. <br /> CORRECTIVE ACTION: Since it could not be demonstrated how long this UW was stored on site, immediately <br /> dispose of this UW in accordance with Title 22 California Code of Regulations. Provide a corrective action <br /> statement,the disposal record and supporting documentation to the San Joaquin County Environmental Health <br /> Department(EHD)within 30 days. <br /> This is a Class 11 violation. <br /> Overall Inspection Comments: <br /> Notes: <br /> 1. The following is an Aboveground Petroleum Storage Act issue per Title 40, Code of Federal Regulations <br /> (CFR), Sections 112.1 and 112.2: <br /> OBSERVATION: Three empty aboveground tanks, observed next to the diesel fuel tank, are not in use, <br /> according to Anthony Harb, Safety/QA Manager, but have not been properly closed.
