I waste management in California,pursuant to Exhibit C attached. Expenditures made for these <br /> 2 projects prior to the date of entry of this Final Judgment shall be included in any calculation to <br /> 3 determine compliance with this paragraph. These projects are not in mitigation of any penalties <br /> 4 sought by the People. <br /> 5 5.3 Reimbursement of Costs of Investigation and Enforcement <br /> 6 Within twenty-one(21) business days after entry of this Final Judgment,Defendant shall pay <br /> 7 THREE HUNDRED FIFTY THOUSAND DOLLARS(6� ,,0-0008 0.0),for reimbursement of <br /> 8 attorneys' fees, costs of investigation, and other costs of enforcement, to the entities identified in,and <br /> 9 in accordance with the terms of,Exhibits D-1 and D-2, attached. <br /> 10 5.4 Payments and Expenditures <br /> 11 The payment of all civil penalties,reimbursement of cost payments and other expenditures set <br /> 12 forth in paragraphs 5.1 and 5.3, above, shall be made by checks and delivered to the District <br /> 13 Attorney's Office for the County of San Joaquin,Attention: Celeste Kaisch, Deputy District <br /> 14 Attorney, for distribution pursuant to the terms of this Final Judgment. <br /> 15 6. ENFORCEMENT OF FINAL JUDGMENT AND PENALTIES <br /> 16 Except as expressly stated in Paragraph 7 below, the People may move this Court for <br /> 17 additional relief for any violation of any provision of this Final Judgment including,but not limited <br /> 18 to, contempt,additional injunctive provisions, or additional penalties consistent with the provisions of <br /> 19 this Final Judgment. Except as expressly stated in this Final Judgment,nothing herein shall limit any <br /> 20 rights of the People to seek any other relief or remedies provided by law, or the rights of Defendant to <br /> 21 defend against any request of the People for such other relief or remedies. <br /> 22 7. MATTERS COVERED BY THIS FINAL JUDGMENT <br /> 23 7.1 This Final Judgment is a final and binding resolution and settlement of all <br /> 24 violations and causes of action arising from the facts set forth in the Complaint as to the Included <br /> 25 Facilities and covers Defendant and Defendant's predecessors and successors in interests,parent <br /> 26 corporations, and subsidiaries, along with their past,present and future directors, officers,and <br /> 27 employees,and shall be known as"Covered Matters."A "Reserved Claim"is any claim,violation, or <br /> 28 cause of action that is not a Covered Matter. Reserved Claims include,without limitation, any <br /> 12 <br /> STIPULATION FOR ENTRY OF FINAL JUDGMENT AND PERMANENT INJUNCTION <br />
