1 14. FUTURE REGULATORY CHANGES <br /> 2 Nothing in this Final Judgment shall excuse Defendant from meeting any more-stringent <br /> 3 requirement that may be imposed by applicable existing law or by any change in the applicable law. <br /> 4 To the extent any future statutory or regulatory change makes Defendant's obligations Iess stringent <br /> 5 than those provided for in this Final Judgment, Defendant's compliance with the changed law shall <br /> 6 be deemed compliance with this Final Judgment;however, any change in law or regulation shall not <br /> 7 reduce or diminish Defendant's obligations to comply with Paragraph 4.4., above. <br /> 8 15. TERMINATION OF COMPLIANCE PROGRAM <br /> 9 Defendant's obligations to engage in a compliance program pursuant to Paragraph 4.4 of this <br /> 10 Final Judgment shall terminate five (5) years after the Effective Date of this Final Judgment. <br /> 11 16. APPLICATION OF FINAL JUDGMENT <br /> 12 This Final Judgment shall apply to and be binding upon the People and upon Defendant and <br /> 13 its officers,directors,employees, successors and assigns. <br /> 14 17. AUTHORITY TO ENTER FINAL JUDGMENT <br /> 15 Each signatory to this Final Judgment certifies that he or she is fully authorized by the party <br /> 16 he or she represents to enter into this Final Judgment,to execute it on behalf of the party represented, <br /> 17 and to legally bind that party. <br /> 18 18. CONTINUING JURISDICTION <br /> 19 The Court shall retain continuing jurisdiction to enforce the injunctive terms of this Final <br /> 20 Judgment and Permanent Injunction and to address any other matters arising out of or regarding this <br /> 21 Final Judgment. <br /> 22 19. ABILITY TO INSPECT AND COPY RECORDS AND DOCUMENTS <br /> 23 Defendant shall permit any duly authorized representative of the People to inspect and copy <br /> 24 non-privileged records and documents relevant to determine compliance with the terms of this Final <br /> 25 Judgment,provided that the People may not request records or documents relating to or constituting <br /> 26 any internal or third-party audits the Defendant may choose to conduct related to environmental <br /> 27 compliance. This paragraph shall not limit the People's authority to access or obtain information, <br /> 28 records and documents pursuant to any other law, statute, or regulation. <br /> 16 <br /> STIPULATION FOR ENTRY OF FINAL JUDGMENT AND PERMANENT INJUNCTION <br />
