d. Interfere substantially with the movement of any native resident or migratory fish or <br /> wildlife species or with established native resident or migratory.wildlife corridors, or <br /> impede the use of native wildlife nursery sites. <br /> The project area may be used as a wildlife corridor to nearby water sources by coyote, kit <br /> fox, and other mammals. It is expected that the general use of the area as a corridor will <br /> be between dusk and dawn (USFWS 1999; CDFG 2003). If the above protection <br /> measures are followed, project activities should avoid substantial interference. <br /> e. Conflict with local policies or ordinances protecting biological resources, such as a tree <br /> preservation policy or ordinance. <br /> The only trees observed on the Site during the site visit January 31, 2003, were small <br /> weedy species (tree tobacco). In addition, no trees or other vegetation occurs on the <br /> areas to be excavated. Project activities are not expected to conflict with local policies or <br /> ordinances protecting biological resources, such as a tree preservation policy. <br /> f. Conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community <br /> Conservation Plan, or other approved local, regional, or state habitat conservation plan. <br /> A Habitat Conservation Plan (HCP) entitled San Joaquin County Multi-Species Habitat <br /> Conservation and Open Space Plan (SJMSCP)was adopted by the San Joaquin Council <br /> of Governments (SJCG 2000). The SJMSCP provides compensation for conversion of <br /> open space to non-open space uses that affect plant,fish, and wildlife species.The <br /> compensation provided by the SJMSCP intends to comply with ESA Section 10(a)(1)(B) <br /> and the California Endangered Species Act Section 2081(b), Incidental Take Permits. <br /> Coverage under the existing SJMSCP was not obtained for this project because the <br /> above protection measures are incorporated into project activities and the project will <br /> result in increased habitat and open space. LFR has communicated with CDFG (Gifford <br /> 2003), USFWS (Zerrenner 2003), and SJCOG (Park 2003) regarding the SJMSCP; it <br /> was determined that coverage was not appropriate for project activities. The project is <br /> therefore not in conflict with the SJMSCP. <br /> Findings of Significance: <br /> ❑ Potentially Significant Impact <br /> ❑ Potentially Significant Unless Mitigated <br /> X Less Than Significant Impact <br /> ❑ No Impact <br /> 5.
