LFR Levine-Fricke <br /> • All construction pipes, culverts, or similar structures with a diameter of 4 <br /> inches or greater that are stored at the project site should be thoroughly <br /> inspected for kit foxes before they are used or moved in any way. <br /> • All food-related trash items should be disposed of in closed containers and <br /> removed at least once a week from the project site. <br /> • No firearms shall be allowed at the project site. <br /> • No pets shall be permitted at the project site. <br /> • A representative shall be appointed by the project proponent who will be the <br /> contact source for any employee or contractor who might inadvertently kill or <br /> injure a kit fox or who finds a dead, injured, or trapped individual. Any project <br /> personnel who inadvertently kills or injures a kit fox shall immediately report <br /> the incident to their representative. <br /> • In the case of trapped animals, escape ramps or structures should be installed <br /> immediately. <br /> • The Sacramento USFWS and CDFG will be notified in writing within three <br /> working days of the accidental death or injury to a kit fox during project-related <br /> activities. <br /> If the proposed action changes in any manner that may affect kit fox, or if occupied <br /> dens are encountered, further consultation with the USFWS will be necessary. In <br /> addition, the USFWS requests that they be informed, in writing, of the survey results <br /> within five days of the survey. Project activities are expected to result in increased <br /> habitat value and long term beneficial impacts for the kit fox population. Project <br /> activities are expected to have a less than significant impact on kit fox because of the <br /> incorporated protection measures. <br /> California Burrowing Owl: Specific Conservation Measures <br /> • A qualified LFR biologist will conduct a preconstruction survey within 30 days <br /> prior to project activities to determine if burrowing owls occupy habitat on or <br /> adjacent to the project site. The survey will follow protocol as outlined in the <br /> Burrowing Owl Survey Protocol and Mitigation Guidelines (California Burrowing <br /> Owl Consortium 1993). If possible, a nesting season survey will be conducted <br /> between April 15 and July 15. A winter survey will be required only if there is a <br /> cessation of field work for more than 30 days during the remediation activities. <br /> • As described in the Staff Report on Burrowing Owl Mitigation(CDFG 1995), a <br /> written report shall be submitted to the CDFG upon survey completion. <br /> • Impact avoidance shall be the preferred method of dealing with potential project <br /> impacts. No disturbance will occur within 50 meters (approximately 160 feet)of <br /> occupied burrows during the non-breeding season from September 1 through <br /> January 31 or within 75 meters(approximately 250 feet) during the breeding season <br /> from February 1 through August 31. <br /> Final_RAP_Tracy_9.18.03(final).doc Page 27 <br />
