LEA Advisory 20 Attachment-Inspection Guidance for SW Landfills Page 45 of 52 <br /> MSWLF units which dispose of less than 20 tons of municipal solid waste daily and otherwise meet <br /> the small landfill exemption criteria in 40 CFR §258.1(f) are not subject to the following regulations <br /> until October 9, 1995. MSWLF units which have any evidence of ground-water contamination are <br /> not eligible for this exemption. <br /> 17258.10 Airport Safety <br /> (a) Owners or operators of new Municipal Solid Waste Landfill units (MSWLF), existing <br /> MSWLF units, and lateral expansions that are located within 10,000 feet(3,048 meters) of any <br /> airport runway and used by turbojet aircraft or within 5,000 feet(1,524 meters) of any airport <br /> runway end used by only piston-type aircraft must demonstrate that the units are designed and <br /> operated so that the MSWLF unit does not pose a bird hazard to aircraft. <br /> (b) Owners or operators proposing to site new MSWLF units and lateral expansions located <br /> within a five-mile radius of any airport runway end used by turbojet or piston-type aircraft must <br /> notify the affected airport and the Federal Aviation Administration (FAA). <br /> (c) The owner or operator must place the demonstration made pursuant to paragraph (a) of this <br /> section in the operating record and notify the board that it has been placed in the operating record. <br /> Definitions: <br /> (d) For purposes of this section: <br /> (1) "Airport"means public-use airport open to the public without prior permission <br /> and without restrictions within the physical capacities of available facilities. <br /> (2) "Bird hazard"means an increase in the likelihood of bird/aircraft collisions that <br /> may cause damage to the aircraft or injury to its occupants. <br /> The inspector should obtain a map of the area and, with a compass or ruler, measure the distance <br /> between the airport and the MSWLF unit. If it meets the distance criteria and the definition of <br /> "airport" (the inspector may check with the airport or FAA to determine if the airport is a public <br /> facility as defined in this standard), then the inspector should verify the following: <br /> 1. A demonstration has been done if the landfill is within 5000 feet of an airport used by piston- <br /> type aircraft or 10,000 feet of a runway used by turbojet aircraft. <br /> 2. A demonstration has been placed in the operating record and the Board notified. <br /> 3. Any MSWLF or lateral expansion of an existing unit that began operating after the effective <br /> date of these regulations has notified the affected airport and FAA. <br /> A determination of the adequacy of this demonstration is not necessary but may be appropriate if the <br /> inspector believes a potential bird hazard exists. The demonstration should address at least the <br /> following: <br /> 1. Is the airport facility within the regulated distance? <br /> 2. Is the runway part of a public-use airport? <br /> 3.
