Wilson Way SITE CODE: 9031 <br /> Stockton, Ca <br /> A recent telephone conversation between your attorney and San <br /> Joaquin County Public Health Services, Environmental Health <br /> Division (PHS/EHD) has clarified the intent of the work proposed <br /> in the workplan dated April 18, 1994 . <br /> However, the workplan mentioned above describes proposed work in <br /> conjunction with previous site work conducted for the purpose of <br /> investigating the release from the underground storage tanks <br /> formerly located on the property. In a letter to you dated May <br /> 4, 1994 , PHS/EHD found this workplan inadequate with respect to <br /> the investigation and cleanup of the release of petroleum from <br /> the underground storage tanks formerly located on the property. <br /> Proposed site work found to be inadequate for the purposes of an <br /> underground storage tank investigation but implemented soley for <br /> the purposes of litigation cannot be provided oversight through <br /> the Local Oversight Program. In addition, work conducted for the <br /> purposes of litigation only may be ineligible for reimbursement <br /> by the State Water Resources Control Board's Underground Storage <br /> Tank Cleanup Fund Program. <br /> Therefore, based on the above considerations, PHS/EHD is <br /> returning the workplan to you as the workplan clearly proposes <br /> work associated with the past underground storage tank <br /> investigation. <br /> To complete an assessment separate from the underground storage <br /> tank assessment work, you may submit a workplan describing the <br /> construction specifications and the location of proposed wells. <br /> Any information in the workplan connecting the proposed work to <br /> the underground tank site work should be avoided as it may cause <br /> the workplan to be evaluated pursuant to underground tank <br /> regulations. <br /> A Division of San Joaquin Coumv Health Care Service, <br />
