Wilson Way SITE CODE: 9031 <br /> Stockton, Ca <br /> San Joaquin County Public Health Services, Environmental Health <br /> Division (PHS/EHD) has received a letter from your attorney, <br /> dated May 18, 1994 , and has the following comments for your <br /> consideration. <br /> PHS/EHD does not evaluate workplans for the purposes of private <br /> litigation. PHS/EHD evaluates workplans to ensure that site <br /> assessment and cleanup are being conducted pursuant to the Health <br /> and Safety Code, the Underground Storage Tank Cleanup <br /> Regulations, and any applicable policies or guidelines set forth <br /> by the State of California Environmental Protection Agency. The <br /> letter from your attorney is correct, these two purposes cannot <br /> be confused. <br /> In addition, PHS/EHD has, in previous correspondence to you, <br /> explained the need for additional data to allow this agency to <br /> evaluate possible influences from off site sources and to <br /> eliminate your site as the source to the groundwater <br /> contamination. The Central Valley Regional Water Quality Control <br /> Board has concurred that this additional data is needed. You <br /> have elected to petition this determination to the State Water <br /> Resources Control Board (SWRCB) . <br /> Although the petition process has been lengthy, a decision is <br /> expected from the SWRCB regarding this site in the near future. <br /> Until a response has been received from the SWRCB regarding this <br /> site, PHS/EHD will continue to evaluate workplans submitted to <br /> this office as proposals for the investigation and cleanup of a <br /> release from the underground storage tanks previously located at <br /> your site. <br /> PHS/EHD is in no way requesting or forcing you to waive your <br /> rights to appeal to the SWRCB.
