Ms. Laurie Casias <br /> September 3, 1993 <br /> Page 3 <br /> SITE ADDRESS: <br /> 102 South Wilson Way <br /> Stockton, California <br /> Site Code No: 9031 <br /> (2 ) ACTION STATE BOARD IS REQUESTED TO REVIEW: <br /> The State Board is requested to review PAS/EHD's denial of <br /> the following: <br /> (A) Naming of adjacent landowners as additional <br /> responsible parties for groundwater <br /> contamination; <br /> (B) Authorizing implementation of a workplan for <br /> investigating and confirming the relationship <br /> between soil and groundwater contamination at <br /> the Site; <br /> (C) Confirming that Petitioner is secondarily <br /> liable for contamination at the Site. <br /> ( 3 ) DATE ON WHICH LOCAL AGENCY REFUSED TO ACT: <br /> PHS/EHD notified Petitioner by letter on August 9, 1993, <br /> that all three requests were denied. <br /> (4 ) STATEMENT OF REASONS WHY LOCAL AGENCIES ACTION WAS <br /> IMPROPER OR INAPPROPRIATE: <br /> (A) NAMING OF ADDITIONAL RESPONSIBLE PARTIES. <br /> PHS/EHD denied our request to name the past and present <br /> owners and operators of 101 South Wilson Way ( "Adjacent <br /> Landowners' ) as additional responsible parties for groundwater <br /> contamination because it has not been determined that the <br /> groundwater contamination is originating from an off-site source. <br /> This denial was improper for the following reasons: <br /> 1. At the outset, it has been determined by historical <br /> groundwater data that 101 South Wilson Way is located directly <br /> up-gradient from the Site, where groundwater contamination has <br /> been discovered.
