Don Roek <br /> Page 2 <br /> Please be advised that a directive from this office to proceed with corrective action is an enforcement <br /> action and that sites are not removed from the program until corrective action has been satisfied and the <br /> site is certified with closure. It is the responsibility of each listed responsible parry to comply with the <br /> requirements of Section 25299.37, Chapter 6.75 of the California Health and Safety Code. PHS/EHD is <br /> the regulatory agency responsible for ensuring compliance with the laws and regulations governing <br /> underground storage tanks and the Loral Oversight Program is the vehicle by which PHS/EHD <br /> accomplishes that goal. Responsible parties are encouraged to cooperate with each other so that <br /> corrective action will progress and the site will remain in compliance with Chapter 6.75 of the California <br /> Health and Safety Code and also with the Underground Storage Tank Regulations (California Code of <br /> Regulations, Title 23, Chapter 16). Additional enforcement action against responsible parties is used only <br /> as a last resort effort to achieve compliance. Additional enforcement may result in substantial fines and <br /> penalties for responsible parties. <br /> There is a provision in our contract with the State Water Resources Control Board (State Board) that <br /> allows any responsible party to petition the State Board for reconsideration of remedial actions required by <br /> the Contractor (PHS/EHD). You may contact the State Board for information on the petition procedure. <br /> It is hoped that this letter will clarify the issues raised in the letter from your attorney and that cleanup <br /> activities at your site can proceed in a timely manner.
