This is incorrect. Roek Brothers and Roek <br /> Construction are two separate and distinct legal entities. Roek <br /> Brothers is the only legal entity which had held any ownership <br /> interest or control over the Site. Thus, any references to Roek <br /> Construction as a responsible party should be removed. <br /> A. Background <br /> Roek Brothers purchased the Site in 1985, seven years <br /> after the underground storage tanks were removed from the Site. <br /> Roek's application to the Underground Storage Tank Cleanup Fund <br /> was denied, as it was never the "owner" of the tanks. Upon <br /> discovery of soil contamination, Roek undertook a full investiga- <br /> tion, undertook extensive efforts to have the Site placed in the <br /> Local Oversite Program ("LOP") , and have worked toward <br /> remediation of soil at the Site. <br /> At this point, the Roeks believe fundamental legal <br /> issues must be resolved prior to proceeding with further investi- <br /> gation and remediation at the Site.
