WILSON WAY
STOCKTON, CA 95205
YOUR SITE CODE: 9031
Dear Ms. Cotulla:
By way of introduction, my name is Marlene Hanson. I am
a PepsiCo, Inc. attorney currently servicing Pepsi-Cola
Company and its affiliate, company-owned bottling operations.
The "Notice of Reimbursement" respecting your identification
of Pepsi-Cola San Joaquin Bottling Company as an additional
responsible party for the above-referenced contaminated
underground tank site has been referred to my attention.
Please direct any and all further correspondence on this
matter to my attention, c/o Pepsi-Cola Law Department, 1
Pepsi Way, Somers, New York 10589 (Fax No. (914) 767-7944) .
We have not to date been able to conclusively determine
that Pepsi-Cola San Joaquin Bottling Company, Inc. ("Pepsi
San Joaquin") , the entity to which your Notice is addressed,
ever itself, or as a successor-in-interest to various other
companies, owned or operated the referenced contaminated
site. It is my understanding that this property was formerly
owned by Pepsi-Cola Bottling Company of Stockton, Inc.
("Pepsi Stockton") , which at one time was a subsidiary of
Grand Metropolitan Incorporated ("Grand Met") , or in turn, a
subsidiary of one of Grand Met's other subsidiaries.
Although PepsiCo, Inc. purchased Pepsi San Joaquin and
another wholly owned subsidiary of Grand Met in August, 1988
(which we note is long after the sale of the property to Roek
Bros. in early December, 1985) , the Pepsi Stockton entity (or
any successor corporate entity thereto) , as far as we have
been able to determine, was not a part of that transaction.
Obviously, it has been very difficult for us to trace
the corporate history of Pepsi Stockton since that company
was dissolved by Grand Met many years before our San Joaquin
