To: 'Sunil Bali' <sbali@nixonegli.com>
Cc: 'Raymond Clark' <rclark@nixonegli.com>; 'Dana Randall' <drandall@nixonegli.com>
Subject: RE: Inspection Report/Return to Compliance Certification, 800 East Grant Line Rd.Tracy, Ca
Hi Sunil,
After reviewing your return to compliance I was able to close out violations 108 & 111. 1 will go over what additional
information is needed to close the remaining open violations.
-Violation 301 remains open because the statement provided mentions heavy oil stains in the parking oil being placed in
a container. However, I need to know what was used to clean the oil stains around the 400 gallon used oil tank, the
heavy oil stains in the parking area. I also need a picture of the container with a clear shot of the hazardous waste label
used to collect the hazardous waste or a copy of a manifest for the removal of the hazardous waste generated from
cleaning the used oil. We cleaned up the waste oil tank, with solvent and industrial shop rags. This action seem to cut oil
and cleaned the tank well.We dug out the oil stains in the equipment parking lot and disposed of the material in the
solid hazardous waste container. Photos are 1685 and 1686. Photo 1673 shows the label on the tank, its attached.
-Violation 403 remains open due to the following. One white 55 gallon container with used oil in the empty container
storage area, you provided a picture of it however did not mention what happened to the contents and the photo still
shows that it is open.Another reason is for the 400 gallon used oil tank, the funnel leading to the used oil tank still
remains open. The last reason why the violation remains open is because there are multiple photos provided that show
the containers are not fully closed. Please be sure the rings around the lid are screwed shut when submitting photos.
The white 55 gallon drain pan had a pump in it, we removed it and dumped the oily contents in the used oil tank. We
removed the funnel and plugged the used oil tank.
Please see pictures 1679, 1688 and 1689.
-Violation 406 you state you reduced the number of barrels and provided photos. You do not mention what happened to
the barrels. Also the barrels that remain are still missing the word "empty" and an empty date. We provided photos
showing the word "empty" and a start date. Photos 1667, 1668, 1669 and 1670 are attached
-Violation 605 No photo of the hazardous waste label for one white 55 gallon container with used oil observed with no
hazardous waste label. This is in reference to the container found in the empty storage area. You provided a photo to a
hazardous label for oily solids. The inspection report states that the Five 55 gallon containers with oily solids had their
accumulation start date corrected on site. Attached "PDF" 00337120191004110300 is the waste manifest copy of when
the asphalt barrels were hauled off site. These container are not on the premises.
-Violation 608 can you provide a closer and clear photo of the labels for the 55 gallon containers with used drained oil
filters. The photos provided are not clear enough to check if all requirements are on the label. Please see attached
photos 1675, 1677, 1678, 1683 and 1684. Pictures of oil filter container labels.
I hope this email helps with returning to compliance.
If you have any questions please feel free to contact me.
Have a great weekend,
JASON GAITAN
EHS
San Joaquin County
Environmental Health Department
1868 E.Hazelton Ave.Stockton,CA 95205
(209)561-7298
3
