OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifest (UHWM)numbers 016987699JJK(6/13/2017),016987838JJK(9/6/2017),016987902JJK(10/18/17), 016987920JJK(11/13/2017), 018248656JJK(2/22/2018), 018248817JJK(5/17/2018), 018248965JJK(8/16/2018), 018248976JJK(8/7/2018), 019676747JJK(12/5/2018),and 019676593JJK(7/10/2019). REGULATION GUIDANCE: (a)A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (c)A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste is submitted,within 60 days from the date that the hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the manifest,with some indication that the generator has not received confirmation of delivery. (d)Generators shall submit the information to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento,CA 95812-0806 CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator. This is a Class II violation. 301 CCR 66262.34(d)(2)Facility not maintained to minimize the release of a hazardous waste. OBSERVATION: In the hazardous waste storage area, used oil was observed pooling on top of a black 55 gallon steel drum. REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the possibility of a fire, explosion,or any unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to air,soil,or surface water which could threaten human health or the environment. CORRECTIVE ACTION: Immediately clean the drum to prevent any releases. Manage the waste according to Title 22 California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the San Joaquin County Environmental Health Department describing the storage and final disposition of the cleaned up waste.
