i <br /> The project has been reviewed to ensure that it is minor, that it is in compliance with <br />' Title 97 and that there are no impacts substantially different from those previously <br /> approved With this in mind it has been determined that the project will not be <br /> detrimental to public health, safety or welfare, or to the property or residents in the <br />' vicinity <br /> The approval is subject to the following conditions: <br />' 1 Modification shall be as depicted on submitted site plan <br /> 2 There shall be no barbed wire or razor wire installed on the fencing enclosure <br />' Background <br />' The current use at 2072 W Airport Way includes a service station, mini-mart and minor auto <br /> repair It has been confirmed that there is a presence of petroleum hydrocarbons in the <br /> groundwater and drinking water wells north of the site, which emanate from the subject site <br />' The hydrocarbons identified include MTBE and other fuel hydrocarbons The Public Health <br /> Services have concluded that partial hydraulic control of contaminant migration my be feasible <br /> and therefore the property owner has contacted the applicant, Aqua Sciences, to install the air <br />' sparge equipment <br /> The equipment installed will pump water up from the ground, filter it and then discharge it into <br />' the sewer system The protect will discharge approximately 14,000 gallons per day into the <br /> city's sewer system It has been determined that the protect is part of the remediation of a <br />' health issue and temporary in nature, therefore sewer can be issue under ordinance #1167 <br /> which allows for temporary emergency sewer discharges <br />' The installation of remediation equipment and fencing will be the first phase in the clean up of <br /> the site Any future modification of this equipment shall require additional review by the <br /> Community Development Department <br />' No public hearing is required because no substantial effect is anticipated to property rights of <br /> nearby property owners <br />' This decision shall be final on expiration of ten calendar days from and including the date of <br /> decision, unless a notice of appeal is filed with the Planning Department within said time period <br />' The appeal shall be in written form and shall be accompanied by a $100 00 appeal filing fee <br /> The appeal will be scheduled for public hearing consideration by the Planning Commission <br />' If there should be any questions, please contact this office <br /> Sincer ly, <br />' j C� <br /> • Ger Id aycraft <br />' Com unity Development Director <br /> 1 <br />
