• <br /> ACCESS AGREEMENT <br /> THIS AGREEMENT, entered into in the County of San Joaquin, State of <br /> California, by and between Frank Guinta, Jr, hereinafter called "Guinta" and Sid <br /> Guevara hereinafter called "Owner" <br /> Whereas, Owner owns real property in the County of San Joaquin, State of <br /> California, known commonly as 17717 Airport Way, Manteca, Ca located within <br /> 1200 Feet of the property owned by Guinta located at 2072 W Yosemite Ave, <br /> Manteca, California, <br /> Whereas, said property belonging to Owner may have been impacted by MTBE <br /> contamination, <br /> Whereas, it is Owner's desire that all reasonable efforts be made for remediation <br /> of the conditions upon said property, <br /> Whereas, Guinta has commenced a project of remediation under the supervision <br /> • and direction of the County of San Joaquin, Public Health Services, <br /> Environmental Health Division and The State of California Water Resources <br /> Control Board and The Central Valley Regional Water Quality Control Board with <br /> regards any such contamination, <br /> Whereas it is necessary to access the property of Owner to investigate, collect <br /> soil and water samples, <br /> Whereas, consultants and contractors of Guinta, including but not limited to Aqua <br /> Science Engineers, Inc , will accomplish such investigation and analysis and this <br /> Agreement shall extend to the consultants and contractors hired by Guinta <br /> NOW THEREFORE, Owner agrees to permit access and consents to the <br /> following activities on or under the property located at 17717 Airport Way, <br /> Manteca, Ca <br /> DRILLING SOIL BORINGS <br /> There is a need to drill borings on a portion of your property as indicated on the <br /> enclosed map These borings are small holes in the ground used to collect <br /> geologic information and/or soil and groundwater samples These holes are <br /> typically 2 to 3-inches in diameter and are immediately filled with cement to the <br /> surface Guinta agree to repair any damage that may occur as a result of this <br /> drilling Guinta also agree to only work during any mutually acceptable hours, <br /> Pagel of 2 <br /> Bocum=2 <br />
