M m <br /> x p <br /> 0 > Table 2-2 <br /> Summary of Impacts and Mitigation Measures <br /> CD <br /> "' Significance Significance <br /> C <br /> Impacts Before Mitigation Measures After <br /> Mitigation Mitigation <br /> prevent reoccupation of the project site(also found at <br /> http://www.sjcog.org/).If these measures are not attempted or <br /> are attempted but fail,and burrowing owls occupy the project <br /> site,then the following measures will be implemented: <br /> • During the nonbreeding season(September 1–January 31), <br /> burrowing owls occupying the project site will be removed <br /> from the project site by passive relocation as described in <br /> DFG's Staff Report on Burrowing Owl Mitigation(DFG <br /> 1995). <br /> • During the breeding season(February 1–August 31), <br /> occupied burrows will not be disturbed and will be provided <br /> with a 75-meter protective buffer until the Technical <br /> Advisory Committee(TAC with the concurrence of the <br /> permitting agencies'representatives on the TAC—or a <br /> qualified biologist approved by the permitting agencies <br /> verifies through noninvasive means that either the birds <br /> have not begun egg laying,or juveniles from the occupied <br /> burrows are foraging independently and are capable of <br /> independent survival.Once the fledglings are capable of <br /> independent survival,the burrow can be destroyed. <br /> CD <br /> v White-Tailed Kite <br /> pBefore the start of any ground-disturbing activities(e.g.,project site <br /> T grading),preconstruction surveys will investigate all potential nesting <br /> trees on the project site(e.g.,especially tree tops 15-59 feet above <br /> the ground in oak,willow,eucalyptus,cottonwood,or other <br /> o deciduous trees),during the nesting season(February 15–September <br /> CD_ 15)whenever white-tailed kites are noted on-site or within the <br /> vicinity of the project site during the nesting season.A setback of <br /> 100 feet from nesting areas will be established and maintained during <br /> the nesting season for the period encompassing nest building and <br /> continuing until fledglings leave nests.This setback applies <br /> whenever construction or other ground-disturbing activities must <br /> begin during the nesting season in the presence of nests that are <br /> Z v known to be occupied.
