OBSERVATION: This business has an inactive hazardous waste ID number in the California Department of Toxic Substances Control(DTSC)database. The inactive number is CAL000344657. REGULATION GUIDANCE: A hazardous waste generator shall not treat,store, dispose of,transport or offer for transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification (ID)Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per month, less than 1 kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID numbers are unique to a business and site location. CORRECTIVE ACTION:Go to the DTSC web site at hftps://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ to reactivate your ID number. Immediately reactivate your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days. This is a minor violation. 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. OBSERVATIONS: The facility contracts maintenance companies to service their equipment. Hyundai services one loader, Road Machinery services one loader,JM Equipment services 5 forklifts,and Rogers Machinery services 1 compressor. According to the vice president of operations, Jesus Redublo, if oil leaks from a machine,absorbent is placed to contain the spill. The waste generated from the incident will then get taken back to the contractor's service yard for disposal. REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive or ignitable. CORRECTIVE ACTION: Immediately cease disposal, make a hazardous waste determination for oily absorbent, and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your hazardous waste generator status. This is a minor violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by August 27, 2020.
