BASE FOR NOT NEEDING A FEDERAL PERMIT: In order to demonstrate etigibilityfor one of the onsite treatment tiers,facilities are required to provide the basis for determining that a hazardous waste permit is not required under the federal Resource Conservation and Recovery Act (RCR4) and the federal regulations adopted under RCRA (Mle 40, Code of Federal Regulations (CFR)).
