Exhibit D <br /> Smart& Final's and Cash & Carry's Hazardous Waste <br /> Minimization and Enhanced Compliance Projects <br /> Smart&Final, LLC and Cash& Carry, LLC ("Defendants") have implemented, or will <br /> implement,the below programs designed to enhance the performance of Defendants' <br /> hazardous waste management in California to comply with Paragraph 5.3. To implement <br /> these programs, on or before five years following entry of this Final Judgment, Defendants <br /> will collectively spend a minimum of SEVENTY-FIVE THOUSAND DOLLARS <br /> ($75,000),in accordance with Paragraph 5.3. <br /> Enhanced Waste Characterization Data. Defendants have contracted with The WERCS <br /> to provide hazardous waste determinations for products sold by Smart&Final and Cash& <br /> Carry and will continue to use WERCS for five years following entry of this Final <br /> Judgment. <br /> Hiring Additional Hazardous Waste Management Employee. Defendants will hire one <br /> additional employee to devote fifty percent(50%) or more of his or her hours dedicated to <br /> Defendants' California Environmental, Health and Safety programs, by the effective date <br /> of this Final Judgment. <br /> Exhibit D to Stipulation for Entry of Final Judgment and Permanent Injunction in People v.Smart&Final,LLC, et al. 1 of 1 <br />
