Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />September 12, 2019 <br /> Facility Address: <br /> 10304 W LINNE RD, TRACY <br /> Facility Name: <br /> Oldcastle Infrastructure <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br />OBSERVATIONS: The following was observed in the hazardous waste storage area near the spill kit: <br />- One approximately blue 15 gallon container with unknown contents observed with no label. <br />Note: Operator and employee could not determine what was in the container. <br />- One parts washer machine observed in the production facility. <br />Note: Operator states that he does not know if the parts washer waste is hauled off as hazardous waste. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br />as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br />wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br />or ignitable. <br />CORRECTIVE ACTION: Immediately label approximately 15 gallon blue container with unknown contents, make a <br />hazardous waste determination for each waste , and manage it according to Title 22 CCR. Use Safety Data Sheets <br />(SDS), waste sampling and test results or other knowledge to support your hazardous waste determination. Waste <br />testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. <br />Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br />storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br />determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br />hazardous waste generator status. <br />This is a minor violation. <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br />OBSERVATION: Copies of consolidated manifest receipts from 9/12/2016 to 9/12/2019 for hazardous wastes <br />including used oil were not found on site during the inspection <br />REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br />This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br />the regulated activity or as requested by the department or a certified unified program agency. <br />CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts for used oil from <br />9/12/2016 to 9/12/2019 and maintain them on site.
