There was also a tote with the top <br />cut out in the manufacturing area that was used for drying. Any person who generates a waste shall determine if <br />the waste is a hazardous waste. Immediately make a hazardous waste determination for any waste chemicals <br />before they are dried and manage it according the Title 22 hazardous waste regulations. Submit a statement and <br />supporting documentation explaining how this waste was managed. <br />This is a minor violation. <br />204 <br />HSC 25201(a) Failed to obtain a permit to treat hazardous waste. <br />Per Mark Granados, Director, R & D, glycol ether is being evaporated from open containers of chemicals before <br />disposal as nonhazardous waste (plastic tote in the manufacturing area). Hazardous waste is being treated by <br />evaporating glycol ether. The facility does not have a permit to treat hazardous waste. Immediately stop treating <br />hazardous waste without a permit. Contact the Department of Toxic Substances Control (DTSC) to apply for a <br />treatment permit. <br />Note: Per the Safety Data Sheet (SDS) for Glycol Ether EB, glycol ether has an acute oral toxicity of LD50 = <br />1300mg/kg in rats making it hazardous waste per Title 22 California Code of Regulations section 66261.24. <br />This is a Class I violation. <br />601 <br />CCR 66262.34(d) Stored hazardous waste onsite greater than 180 days. <br />Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste <br />stored on site at any time may store waste on site up to 180 days. These containers were identified as hazardous <br />waste and did not have an accumulation start date: <br />-12 black metal 5 gallon buckets on a pallet in the flammable storage room. Some were labeled as "rinse" and "bad <br />rinse" <br />-A shrink wrapped pallet (up to 18 containers) of black five gallon metal buckets observed in the flammable storage <br />room <br />-Two black metal 55 gallon drums observed in the flammable storage room <br />Since it cannot be determined how long the hazardous waste has been on site, immediately contact a licensed <br />hazardous waste hauler to dispose of this waste under manifest.
