Title 7.3 Gov't Code - Solid waste Management and Resource Recovery <br /> (b) Facilities for the recovery of methane gas from disposal sites <br /> are not subject to this section. <br /> [Added Stats 1984 ch 1158; amended Stats 1986 ch 1134; Amended Stats 1988 ch 1446.3 <br /> Sec. 66796.41. Consistency of site with general `plan <br /> (a) Except as provided in Section 66796.42, the board shall not <br /> concur in the issuance of a permit, as provided in subdivision (d) <br /> of Section 66796. 32, for the establishment or expansion of a site <br /> for any solid waste facility unless the city or county in which the <br /> site is located makes a finding that the establishment or expansion <br /> of the site is consistent with the city's or county's applicable <br /> general plan. This finding shall not be made unless the city or <br /> county has adopted a general plan which complies with the <br /> provisions of Article 5 (commencing with Section 65300) of Chapter <br /> 3 of Division 1 of Title 7. <br /> (b) A site for any new or expanded solid waste facility shall be <br /> found to be consistent with the general plan only if both of the <br /> following requirements are met: <br /> (1) The site is located in a land use area designated or authorized <br /> for solid waste facilities in the applicable city or county general <br /> plan. If an area is zoned for the siting of a solid waste facility <br /> which is designed to produce an alternative source of energy <br /> through the conversion of solid waste material into energy, <br /> synthetic fuels, or reusable materials, the city or county shall <br /> deem this area to be in compliance with this requirement for the <br /> purposes of siting this type of solid waste facility. <br /> (2) The land uses authorized adjacent to and near the site are <br /> compatible with the establishment or expansion of the site. <br /> (c) A city or county shall not authorize land uses adjacent to or <br /> near a site located in an area designated or authorized for solid <br /> waste facilities in the applicable city or county general plan if <br /> the land uses would restrict or preclude the establishment of a <br /> solid waste facility or expansion of the facility or site. <br /> (d) Notwithstanding any other provision of law, a land use permit <br /> authorizing the establishment or expansion of a site for any solid <br /> waste facility shall not be issued unless the city or county in <br /> 77 <br />
