NEW CONSTRUCTION AT AUSTIN ROAD LANDFILL, SAN JOAQUIN COUNTY (CASE #2148) <br /> During a recent inspection of the Austin Road Landfill , Timothy Crandall <br /> discovered that a new waste management unit has been constructed near the western <br /> edge of the landfill and that plans for significant alteration of the cap at the <br /> gas extraction area have been formulated and will be executed within a few months. <br /> Section 13260(c) of the Water Code states"Every person subject to subdivision (a) <br /> shall file with the regional board of that region a report of any material change <br /> or proposed change in the character, location, or volume of the discharge." Waste <br /> discharge requirements (WDRs) for Austin Road Landfill , Order No. 77-288, <br /> Provision B.2 states that "The Discharger shall file with this Board a report of <br /> any material change or proposed change in the character, location, or quantity of <br /> this waste discharge. For the purpose of these requirement (sic) , this includes <br /> any proposed change in the boundaries, contours, or ownership- of the disposal <br /> area." Construction of a new waste management unit (WMU) and altering the cap is <br /> i7-material change in the boundaries and contours of the disposal area. Not <br /> reporting these activities is a violation of Section 13260(c)•,.of the Water Code <br /> and Provision B.2 of WDRs Order No. 77-288. <br /> Section 13264 of the Water Code -states, in part, that "No person shall initiate <br /> any new discharge of waste or make any material changes in any discharge, .. . , <br /> prior to the filing of the report required by Section 13260 and no person shall <br /> take any of these actions after filing the report but before whichever of the <br /> following occurs first: <br /> (1) The issuance of waste discharge requirements pursuant to Section 13263. <br /> (2) The expiration of 120 days after compliance with Section 13260. <br /> (3) The Regional Board's waiver pursuant to Section 13269." <br /> Based on this section, discharge of waste to the newly constructed WMU will be a <br /> violation of the Water Code until revised WDRs are adopted. <br />
