A hazardous waste generator shall not <br />treat, store, dispose of, transport or offer for transportation, hazardous waste without an ID number. If you or your <br />business generates more than 100 kg of RCRA hazardous waste and/or more than one kg of acutely hazardous <br />waste, then you need to obtain an EPA ID number. All others must obtain a State ID number. Go to the DTSC web <br />site https:Hdtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ for the form to apply for an ID number. <br />Immediately obtain an ID number to manage hazardous waste and submit evidence to the EHD. <br />This is a repeat violation, Class II. <br />301 <br />CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br />The secondary containment for the three 55 gallon drums of used oil was observed with a rag plugging the drain <br />hole. Used oil had saturated the rag and created a puddle of oil on the pavement covering an approximate area of <br />1x1 feet. Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of <br />hazardous waste to air, soil, or surface water which could threaten human health or the environment. Immediately <br />clean up the oil puddle and manage according to Title 22 hazardous waste regulations. Submit a statement and <br />supporting documentation explaining how this waste was managed. <br />This is a repeat violation, Class II. <br />302 <br />CCR 66262.34(4)(2) Failed to maintain required emergency equipment. <br />Spill control equipment was not found on site. All facilities shall be equipped with an internal communication or alarm <br />system, a device capable of calling outside emergency help, spill control equipment, and decontamination equipment <br />at all times. Immediately provide spill control equipment and maintain on site. <br />This is a minor violation. <br />303 <br />CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br />equipment. <br />The secondary containment for the three 55 gallon drums of used oil had approximately an inch of oil and debris in <br />the bottom of it and the drain was plugged with a rag. All facility communications or alarm systems, fire protection <br />equipment, spill control equipment, and decontamination equipment, where required, shall be tested and maintained <br />as necessary to assure its proper operation in time of emergency.
