R5-2006-0039 <br /> AND CEASE AND DESIST'ORDER NO. R5-2006-0040 <br /> (NPDES NO. CA0083682) <br /> FOR <br /> CANADA COVE LIMITED PARTNERSHIP <br /> FRENCH CAMP RV PARK AND GOLF COURSE FACILITY <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region (hereafter Central --� <br /> { Valley Water Board) finds: <br /> �. 1. Waste Discharge Requirements (WDR) Order No. R5-2003-0039 (NPDES No. m <br /> CA0083682), adopted by the Central Valley Water Board on 5 May 2006, authorizes the <br /> Canada Cove Limited Partnership (hereafter Discharger) to discharge tertiary treated <br /> municipal wastewater from the French Camp RV Park and Golf Course Facility to Lone z <br /> Tree Creek, a water of the United States, within the legal boundaries of the Sacramento- <br /> San .Joaquin Delta. WDR Order No. R5-2003-0039 includes effluent limitations for several <br /> constituents with which the Discharger could not immediately comply, therefore, the Central <br /> Valley Water Board also adopted Cease and Desist Order (CDO) No. R5-2006-0040 on <br /> 5 May 2006. <br /> 2. On 29 October 2009, the Discharger submitted a Report of Waste Discharge proposing <br /> interim and long-term discharge to land of treated domestic wastewater at the French <br /> Camp RV Park and Golf Course. The proposed land discharge meets the conditions of <br /> State Water Resources Control Board's Water Quality Order (WQO) No. 97-10-DWQ, <br /> General Waste Discharge Requirements.for Discharges to, Land by Small Domestic <br /> Wastewater Systems, and a Notice of Applicability for coverage under WQO No. 97-10- <br /> 1 DWQ was issued by the Central Valley Water Board's Executive Officer on 10 March 2010. <br /> The Discharger has ceased_ all discharges to surface waters and requested rescission of its <br /> NPDES permit. C <br /> 3. The Discharger and interested parties were notified of the intent to consider rescission of <br /> WDR Order No. R5-2003-0039 and CDO No. R5-2006-0040 and provided an opportunity <br /> for public hearing and an opportunity to submit written views and recommendations. R1 <br /> 4. The Issuance of this Order is exempt from the provisions of the California Environmental <br /> Quality Act (Public Resources Code, Section 21000 et seq.), in accordance with Title 14, <br /> California Code of Regulations, Section 15321. <br /> IT IS HEREBY ORDERED that Waste Discharge Requirements Order No. R5-2003-0039 <br /> (NPDES No. CA00883682) and Cease and Desist Order R5-2006-0040 are rescinded, except <br /> for enforcement purposes. <br />
