TENTATIVE TIME SCHEDULE ORDER R5-2018-XXXX <br /> OAKWOOD LAKE WATER DISTRICT 10 <br /> WASTEWATER TREATMENT FACILITY <br /> SAN JOAQUIN COUNTY <br /> a. To obtain an extension of any deadline, OLWD shall submit a written Request <br /> for Extension to the Executive Officer within 30 days of discovering new facts <br /> or circumstances anticipated to prevent compliance. <br /> b. The Request for Extension shall: <br /> i. Identify all deadlines to be extended; <br /> ii. Describe cause of any delays in compliance (i.e., new facts or <br /> circumstances), <br /> iii. Explain why delays could not have been reasonably foreseen and/or <br /> avoided with the exercise of due diligence; <br /> iv. Estimate the length of all resulting delays, and the anticipated date of <br /> compliance, and <br /> V. Include a proposed schedule for compliance with all remaining relevant <br /> deadlines (including those to be extended). <br /> C. Unless it is approved in writing by the Executive Officer within 30 days of <br /> submission, a Request for Extension shall be deemed denied. <br /> d. The Executive Officer may, in their discretion, approve a Request for <br /> Extension, either as proposed or with modifications, within regard to the <br /> following considerations: <br /> i. Whether OLWD has engaged in timely, good faith efforts to prevent <br /> and/or mitigate delays in compliance with this TSO; <br /> ii. Whether delays result from circumstances beyond the control of OLWD, <br /> its agents, employees, contractors and consultants; <br /> iii. Whether delays could have been prevented with the exercise of due <br /> diligence; <br /> iv. The magnitude and number of estimated delays; and <br /> V. Any other relevant considerations appropriate under the circumstances. <br /> e. Upon approval, the proposed schedule for compliance (as modified) shall be <br /> automatically incorporated as part of this TSO. <br /> f. The Executive Officer may designate an Assistant Executive Officer or other <br /> Central Valley Water Board employee to approve or deny Requests for <br /> Extension submitted pursuant to this section. <br /> 11. The Executive Officer may modify or rescind this TSO at any time. However, except as <br /> provided above regarding Requests for Extension, all modifications and rescissions <br /> must be in a writing signed by the Executive Officer, whose authority is not subject to <br /> delegation. <br />
