According to Rodger Ainsworth, <br />Maintenance Manager, the used oil is taken to the Household Hazardous Waste facility to be disposed of. No <br />receipts are given to the business. Hazardous waste generators shall retain copies of all manifests signed off by the <br />disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them <br />readily available for review. Immediately locate a copy of all manifests and receipts for the last three years, <br />maintain them on site, and submit copies to the EHD. If the facility does not have any disposal records, immediately <br />start to maintain them. <br />This is a Class II violation. <br /> 115 CCR 66266.81(a)(4)(B) Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. <br />Bills of lading or manifests for the management of lead acid batteries for the last three years were not found on site. <br />A copy of each bill of lading must be kept on site for at least three years. Immediately locate a copy of all bills of <br />lading or manifests for lead acid batteries for the last three years, maintain them on site, and submit copies to the <br />EHD. <br />This is a Class II violation. <br /> 303 CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br />equipment. <br />Approximately 2-3 gallons of used oil was observed in the secondary containment in the storage hanger. All facility <br />communications or alarm systems, fire protection equipment, spill control equipment, and decontamination <br />equipment, where required, shall be tested and maintained as necessary to assure its proper operation in time of <br />emergency. Immediately empty the secondary containment and begin this practice. <br />This is a Class II violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br />waste. <br />In the main shop, nine 5 gallon plastic buckets containing used oil were missing hazardous waste labels. <br />All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately <br />close these containers and ensure all hazardous waste containers are closed when not adding or removing waste. <br />This is a Class II violation. <br /> 505 CCR 66262.34(f) Failed to completely label stationary hazardous waste tanks. <br />The used oil tank (1/8 full) in the storage hanger did not have a hazardous waste label. All hazardous waste tanks <br />shall be marked with the words “Hazardous Waste” and the accumulation start date.
