Calcium Hydroxide (carbide lime) is produced at <br />the facility during acetylene gas production. Per Title 22 California Code of Regulation (CCR) Division 4.5, Chapter <br />11, Article 5, Appendix X, Calcium Hydroxide, Hydrated Lime is a presumed hazardous waste, listed as number <br />167. According to Allen Wood, Facility Manager, the Calcium Hydroxide is picked up by AC Trucking and <br />distributed by Gilmour Lime to waste water treatment plants. Small amounts of Calcium Hydroxide can also be <br />shipped to other businesses. Mr. Wood was not certain what the other businesses were. <br />REGULATION GUIDANCE: See California Health and Safety Code (HSC) sections 25143.2 and 25143.9 <br />Title 22 CCR section 66266.21 <br />CORRECTIVE ACTIONS: <br />Immediately do one of the following: <br />1. Begin managing this material as hazardous waste, or <br />2. Demonstrate the Calcium Hydroxide is not a hazardous waste by making a hazardous waste determination per <br />Title 22 CCR section 66262.11, or <br />3. Demonstrate that the material meets the excluded recyclable material (ERM) requirements. <br />Provide the following to satisfy the ERM requirements: <br />1. Show compliance with HSC 25143.2(f)(1)(A) by providing the name, street and mailing address, and telephone <br />number of the owner or operator of the receiving facility that manages the ERM. <br />2. Show compliance with HSC 25143.2(f)(2) by providing documents that demonstrate a known market or <br />disposition for the ERM and resulting product. <br />3. Show compliance with HSC 25143.9 by labeling all containers of the ERM with the words "Excluded Recyclable <br />Material', your business name, address, composition of the ERM, physical state, hazardous properties and the <br />accumulation start date. <br />4. Show compliance with Title 22 California Code of Regulations (CCR) section 66266.21 for all of the businesses <br />that get Calcium Hydroxide generated from this facility, including section 66266.21(b)(3): The recyclable material, <br />either in its existing state or in processed products, shall not be used in agriculture as a fertilizer, soil amendment, <br />agricultural mineral, auxiliary soil and plant substance, or animal feed. <br />Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental <br />Health Department (EHD) within 30 days. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />An inspection report was provided to the facility operator on the day of inspection. The report was amended by <br />the EHD. The amended report replaces the initial report. <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by November 13, 2019. <br />Starting September 1, 2018, all in -office CERS help will be provided at EHD hourly rate ($152).
