STOCKTON <br />Date: <br />December 05. 2019 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # Remarks <br />713 OCR 66273.35 UWH stored UW onsite greater than one year or was unable to demonstrate storage time. <br />OBSERVATION: The facility could not demonstrate that universal waste (UW) has been stored on site for no longer <br />than one year. The following UW was stored on-site: approximately fifty universal waste lamps including large bulbs <br />labeled "HG" for mercury and long tubes. <br />REGULATION GUIDANCE: <br />A universal waste handler shall accumulate universal waste for no longer than one year from the date the <br />universal waste was generated, or was received from another universal waste handler. <br />A universal waste handler shall be able to demonstrate the length of time that the universal waste has been <br />accumulated from the date it became a waste or was received. The universal waste handler may make this <br />demonstration by: <br />Placing the universal waste in a container and marking or labeling the container with the earliest date that any <br />universal waste in the container became a waste or was received; <br />Marking or labeling the individual item of universal waste (e.g., each battery or thermostat) with the date it <br />became a waste or was received; <br />Maintaining an inventory system onsite that identifies the date the universal waste being accumulated became a <br />waste or was received; <br />Maintaining an inventory system onsite that identifies the earliest date that any universal waste in a group of <br />items of universal waste or a group of containers of universal waste became a waste or was received; <br />Placing the universal waste in a specific accumulation area and marking or labeling the area to identify the <br />earliest date that any universal waste in the area became a waste or was received; or <br />Any other method which clearly demonstrates the length of time that the universal waste has been accumulated <br />from the date it became a waste or was received. <br />CORRECTIVE ACTION: Since it could not be demonstrated how long this UW was stored on site, immediately <br />dispose of the UW lamps in accordance with Title 22 California Code of Regulations. Provide a corrective action <br />statement, the disposal record and supporting documentation to the San Joaquin County Environmental Health <br />Department (EHD) within 30 days. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by January 5, 2020. <br />Starting September 1,2018, all in-office CERS help will be provided at EHD hourly rate ($152).
