FINDINGS FOR SITE APPROVAL AND WILLIAMSON ACT PRINCPLES <br /> OF COMPATABILITY <br /> PA-2000116 <br /> OLIVERA FAMILY LTD PTP I NEW CINGULAR WIRELESS PCS, LLC <br /> FINDINGS FOR SITE APPROVAL <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan adopted <br /> by the County. <br /> • This finding can be made because the proposed tower will be located in the AG-80 (General <br /> Agriculture,80-acre minimum)zone,and the Communications Services-Type II use type may <br /> be conditionally permitted in the AG-80 zone with an approved Site Approval application. The <br /> project site also has a General Plan designation of AIG (General Agriculture), and the AG- <br /> 80 zone is an implementing zone for this designation.The proposed communications tower <br /> is consistent with the goals, policies, standards, and maps of the General Plan, and there <br /> are no Master Plans or Special Purpose Plan applicable to this site. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because there are no new utility or roadway improvements required. <br /> The wireless communication tower is an unmanned facility and will not impact existing public <br /> utilities.This project will not require the use of a public water or sewer systems,and all storm <br /> water will be retained on site. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 106.88-acre parcel is of adequate size and shape to <br /> accommodate the proposed use, building coverage, setbacks, and other requirements of <br /> the Development Title. The parcel can accommodate the 124-foot-tall monopole and lease <br /> area.There are no residences on adjoining parcels within the 124-foot fall zone of the tower. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because it was determined that the project will not be detrimental <br /> to the Public Health. The tower must comply with Federal Communications Commission <br /> regulations regarding radio frequency emissions. <br /> 5. The use is compatible with adjoining land uses. <br /> • This finding can be made because the proposed use may be conditionally permitted in the <br /> AG-80 (General Agriculture, 80-Acre Minimum) zone with an approved Site Approval <br /> application. The proposed use will not interfere with nor alter the current land uses on <br /> adjoining properties. The adjacent surrounding parcels are primarily agricultural with <br /> scattered residences.
