Boost meal replacement shakes were <br />found on a sales shelf next to Slim Fast Original meal replacement shakes, both of which had Nutrition Facts labels, <br />inside the facility. The EAS Advant EDGE shakes also had Nutrition Facts labels. Slim Fast Original meal <br />replacement shakes were observed bagged and in a Toxic & OTC (over-the-counter) Pharmaceuticals (TX OTC) <br />hazardous waste (HW) tote. (see photos IMG 5593-4, 5607, 5611-2) <br />- A container of Suavitel fabric softener was found leaking from a broken cap adjacent to the facility mop sink and was <br />not labeled as a store-use item (IMG 5585-7). Monica Gabales, store manager, did not know how long the container <br />had been there. Monica placed the fabric softener in front of the HW storage area to be processed as hazardous <br />waste. <br />Any person who generates a waste shall determine if the waste is a hazardous waste. <br />Immediately stop the disposal of Boost meal replacement shakes and EAS Advant EDGE High Protein shakes into <br />the trash, make a hazardous waste determination for these waste items and for the Suavitel fabric softener, and <br />manage them according the Title 22 hazardous waste regulations. <br />Submit a statement and supporting documentation explaining how this waste was managed. <br />This is a Class II violation. <br />Page 4 of 16 <br />FA0001729 PR0544373 SC001 04/25/2019 <br />EHD 22-01 Rev. 09/27/2018 Small Quantity Hazardous Waste Generator OIR <br />1868 E.
