Environmental Health Department
Small Quantity Hazardous Waste Generator Inspection Report
Date:
April 25, 2019
Facility Address:
2318 S AIRPORT WAY, STOCKTON
Facility Name:
FAMILY DOLLAR #31867
SUMMARY OF VIOLATIONS
(CLASS I, CLASS II, or MINOR - Notice to Comply)
RemarksItem #
102 CCR 66262.11 Failed to determine if a waste is a hazardous waste.
- A package containing what appeared to be six Boost meal replacement shakes and another package containing
EAS Advant EDGE High Protein shakes were found in the facility dumpster. Boost meal replacement shakes were
found on a sales shelf next to Slim Fast Original meal replacement shakes, both of which had Nutrition Facts labels,
inside the facility. The EAS Advant EDGE shakes also had Nutrition Facts labels. Slim Fast Original meal
replacement shakes were observed bagged and in a Toxic & OTC (over-the-counter) Pharmaceuticals (TX OTC)
hazardous waste (HW) tote. (see photos IMG 5593-4, 5607, 5611-2)
- A container of Suavitel fabric softener was found leaking from a broken cap adjacent to the facility mop sink and was
not labeled as a store-use item (IMG 5585-7). Monica Gabales, store manager, did not know how long the container
had been there. Monica placed the fabric softener in front of the HW storage area to be processed as hazardous
waste.
Any person who generates a waste shall determine if the waste is a hazardous waste.
Immediately stop the disposal of Boost meal replacement shakes and EAS Advant EDGE High Protein shakes into
the trash, make a hazardous waste determination for these waste items and for the Suavitel fabric softener, and
manage them according the Title 22 hazardous waste regulations.
Submit a statement and supporting documentation explaining how this waste was managed.
This is a Class II violation.
FA0001729 PR0544373 SC001 04/25/2019
EHD 22-01 Rev. 09/27/2018 Small Quantity Hazardous Waste Generator OIR
1868 E.
