Environmental Health Department Small Quantity Hazardous Waste Generator Inspection Report Date: April 25, 2019 Facility Address: 2318 S AIRPORT WAY, STOCKTON Facility Name: FAMILY DOLLAR #31867 SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) RemarksItem # 202 HSC 25189.5(a) Disposed or caused disposal of HW at an unauthorized point. - Two containers of Ampro Pro Styl protein styling gel were found in a cardboard box behind a register at the front of the facility. One of the containers was broken and leaking, contaminating the box and the second container (IMG 5600-5603). Later, the inspector found the contaminated cardboard box and the containers of Ampro Pro Style protein styling gel in a trash can located behind the register (IMG 5630, 5632). When asked who placed the items into the trash, Monica stated she did not know. When the containers of gel were scanned, the hand held scanner indicated the gel should be placed in a ST HW tote (IMG 5636). Monica removed the two containers of gel and the contaminated cardboard box from the trash and took them to the HW storage area. - A full bottle of Body Fantasies Coconut Fragrance Body Spray was found missing the actuator and in a trash can located behind a register at the front of the facility (IMG 5630-1, 5633). Monica did not know who placed the item in the trash. The hand held scanner indicated Body Fantasies body spray should be placed in the AF HW tote (IMG 5634). Monica removed the body spray from the trash and took it to the HW storage area. - A full bottle of Modesa Vitamin Moisturizing Skin Oil was found in a trash can located behind a register at the front of the facility (IMG 5630-1, 5633). Monica did not know who placed the item in the trash. The hand held scanner indicated the Modesa skin oil should be placed in the CA HW tote (IMG 5635). Monica removed the skin oil from the trash and took it to the HW storage area. Hazardous wastes shall be disposed of only by transportation to a permitted hazardous waste treatment, storage, and disposal facility (TSDF). Immediately cease disposal of hazardous waste to the trash and ensure that all future waste is hauled by a licensed hazardous waste transporter to a permitted TSDF. Submit a statement to the EHD explaining how the above mentioned waste that was found in the trash was managed. This is a Class I violation. 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. A sales shelf was found with spillage of what appeared to be Ajax with Bleach powder cleaner (IMG 5606). The spillage was also on the floor in front of the shelf. The sales tag on the shelf read "Ajax powder cleanser 28oz 14-12099 05364" (IMG 5605). Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could threaten human health or the environment. The Ajax spill was cleaned up, placed in a bag labeled "ST," and into an ST HW tote by a store employee at the time of inspection. This was corrected on site. This is a Class II violation.
