SAN JOAQUIN COUNTY BOARD OF HOUSING APPEALS <br /> STATE OF CALIFORNIA <br /> CORRECTED <br /> ABATEMENT RESOLUTION R 09-61 <br /> PROPERTY LOCATION: 10900 East Tokay Colony Road, Lodi CA <br /> APN#: 063-190-64 and 063-190-65 <br /> OWNER(S): Federal National Mortgage Association <br /> BENEFICIARIES: None <br /> ENFORCEMENT AGENCY: San Joaquin County Environmental Health Department <br /> CASE NUMBER: PR0527067 <br /> SUPERVISOR DISTRICT: #4 <br /> DATE OF HEARING: July 15, 2009 <br /> RESOLUTION AND ORDER OF THE <br /> SAN JOAQUIN COUNTY BOARD OF HOUSING APPEALS <br /> WHEREAS, on July 15, 2009, the San Joaquin County Board of Housing Appeals conducted a <br /> public hearing on this matter, notice of which hearing was given in accordance with law, and <br /> oral and documentary evidence having been received in favor of or opposed to said matter, and <br /> the San Joaquin County Board of Housing Appeals being advised on the premise; and <br /> WHEREAS, the conditions of the property are in violation of the California Health and Safety <br /> Code, Section 17920.3 to an extent that endangers the life, limb, health, property, safety or <br /> welfare of the public or the occupants constituting a substandard building due to general <br /> dilapidation or improper maintenance. <br /> WHEREAS, the conditions of the property constitute a nuisance. <br /> NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the San Joaquin County Board of <br /> Housing Appeals, the Enforcement Agency is authorized to proceed with abatement in a <br /> manner and form prescribed by law, if any of the following time constraints and/or conditions are <br /> not met: <br /> 1. Thirty (30) days to obtain any repair and/or demolition permit(s) for the substandard <br /> structure(s) from the San Joaquin County Community Development Department, 1810 <br /> East Hazelton Avenue, Stockton, CA and the Environmental Health Department, 600 <br /> East Main Street, Stockton, CA. <br /> 2. Thirty (30) days to hire a qualified remediation firm to implement the approved <br /> Preliminary Site Assessment Work Plan. <br /> 3. Ninety (90) day to complete the work as described in the Preliminary Site Assessment <br /> Work Plan and submit a final report to the San Joaquin County Environmental Health <br /> Department. <br /> R 09-61 Page 1 of 2 <br />
