demand restore the security deposit to the original sum deposited. <br /> Should Licensee comply with all of the terms of this License, the <br /> security deposit shall be returned in full to Licensee at the <br /> expiration of this Agreement . <br /> 3 . Term. The License is granted for a period of five (5) <br /> years, beginning on the date of this Agreement . The License shall <br /> terminate automatically at the end of such time period (the <br /> "Deadline" ) , with no need for any party to notify the other of such <br /> termination before it becomes effective . The term of this License <br /> may be extended by written agreement of the parties . <br /> 4 . Cancellation. Either party may cancel this License by <br /> giving the other party at least one (1) year prior written notice <br /> of cancellation. <br /> 5 . Use of License. The use of the License shall be governed <br /> by the following provisions : <br /> (a) Licensee shall be responsible for assuring that the <br /> Excess Water is confined to the License Area, even with the <br /> presence of adverse weather conditions . <br /> (b) Licensee shall use the existing topography to confine the <br /> Excess Water, and shall not perform any earth movement or <br /> construction activities on the Licensor' s Parcel (including the <br /> License Area) to confine the Excess Water to the License Area <br /> without the express prior written consent of Licensor. If such <br /> earth movement or construction activities are consented to by <br /> Licensor, Licensee' s construction of any levees, berms or other <br /> improvements or movement of earth shall be performed in accordance <br /> with all applicable laws, ordinances, rules, regulations and <br /> building codes, and Licensee shall obtain building permits where <br /> required. Licensor reserves the right to condition its approval of <br /> such construction activities or earth movement upon Licensee' s <br /> deposit with Licensor of funds in an amount reasonably determined <br /> by Licensor to be adequate to restore the Licensor' s Parcel, after <br /> termination of this License, to its condition existing at the <br /> commencement of this License . <br /> (c) It is acknowledged that a portion of the Excess Water may <br /> evaporate before the Deadline or earlier termination of this <br /> License . Licensee shall ensure that all of the remaining Excess <br /> Water is removed from the License Area by the Deadline or earlier <br /> termination of this License, and that the License Area is returned <br /> by the, Deadline or earlier termination of this License to its <br /> condition existing prior to the Excess Water being placed on it, <br /> including removal of any levees, berms or other improvements <br /> constructed by Licensee, the regrading of the earth, if necessary, <br /> and the removal of all silts and clays (unless SKS requests in <br /> writing that such silts and clays not be removed) , all at the <br /> expense of Licensee . If Licensee should fail to ensure such <br /> removal of the Excess Water and the return of the License Area to <br /> 2 <br />
