SUMMARY <br /> The San Joaquin County Environmental Health Department (EHD) received a complaint, on <br /> October 6, 2005, regarding discharge of manure to a field. The EHD conducted a complaint <br /> inspection at APN-023-180-03 on October 14, 2005. The EHD observed solid and liquid chicken <br /> manure spread on the property, evidence of fly breeding, and liquid manure in the waterways that <br /> flow through the property. The liquid manure was also flowing onto the adjacent property to the <br /> south. The EHD conducted an inspection of APN-023-250-02 on October 17, 2005, and observed <br /> solid chicken manure spread on the property. SKS Enterprises, a chicken egg laying facility, has <br /> been spreading the chicken manure on the two properties under an agreement with the property <br /> owner, Gary Silva. SKS Enterprises is located at 23709 E. Brandt Rd., Lodi, California. <br /> The manure had accumulated on the properties for several months, which is in violation of San <br /> Joaquin County Ordinance Code §5-2400. This section requires that no owner of a parcel of land <br /> shall allow any collection of waste matter of any kind to accumulate or to remain on such parcel for <br /> longer than seven (7)days. <br /> Application of manure to land in a manner that causes a nuisance is a violation of the Rules and <br /> Regulations Pertaining to San Joaquin County Ordinance 8771, §6A(2). Fly breeding and <br /> contamination of waterways with liquid manure also constitute nuisances. <br /> Application of manure to farming land without discing into the soil on the same day is a violation <br /> of the Rules and Regulations Pertaining to San Joaquin County Ordinance 877, §6A(3). Chicken <br /> manure was spread on the property for several months but was not disced into the soil. <br /> r Rules and Regulations Pertaining to San Joaquin County Ordinance No. 887: An ordinance Providing for the <br /> Collection,Transportation and Disposal of Refuse Within The Unincorporated Area of San Joaquin County,and <br /> Repealing Ordinance No.476 of the County of San Joaquin,as Amended by Ordinances No. 895,920,and 1481. <br />
