The following is an itemized list of hazardous waste violations that have not been <br />addressed for Gillson Trucking Inc. as of November 06, 2020. <br />Open violations from August 10, 2020 inspection <br />Violation #403 - Failed to keep hazardous waste containers closed except when adding or removing hazardous <br />waste. <br />OBSERVATION: The following open hazardous waste storage container was observed on-site: one approximately <br />10 -gallon blue open container containing waste fuel was observed on the east end of the parcel. <br />REGULATION GUIDANCE: A container holding hazardous waste shall always be closed during transfer and storage, <br />except when it is necessary to add or remove waste. <br />CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed <br />when not adding or removing waste. Provide a corrective action statement and supporting documentation to the San <br />Joaquin County Environmental Health Department within 30 days. <br />❑ This violation was corrected ❑ This violation will be corrected by (date): <br />❑ Supporting documents included <br />Describe actions taken or will be taken to correct violation: <br />Violation #601 - Stored hazardous waste onsite greater than 180 days. <br />OBSERVATION: A hazardous waste container was found on-site with no accumulation start date: one approximately <br />10 -gallon blue open container containing waste fuel was observed on the east end with hazardous waste label or <br />accumulation start date. <br />REGULATION GUIDANCE: <br />(a) Except as provided in subsections (c) and (d) of this section and section 66262.35, a generator may accumulate <br />hazardous waste on-site for 90 days or less without a permit or grant of interim status, provided that: <br />(b) The beginning of the 90 day period specified in subsections (a) and (c) of this section is determined as follows: <br />(1) if the generator does not generate more than 100 kilograms of hazardous waste or one kilogram of acutely hazardous <br />waste (listed in section 66261.33(e)) or one kilogram of extremely hazardous waste during any calendar month, the 90 <br />day period begins on the date the generator has accumulated 100 kilograms of hazardous waste or one kilogram of <br />acutely hazardous waste or one kilogram of extremely hazardous waste; <br />(2) if the generator generates more than 100 kilograms of hazardous waste or one kilogram of acutely hazardous waste <br />or one kilogram of extremely hazardous waste during any calendar month, the 90 -day period begins on the first date on <br />which any amount of hazardous waste begins to accumulate during that month. <br />(d) Notwithstanding subsections (a) and (c) of this section and section 66262.35, a generator of less than 1,000 kilograms <br />of hazardous waste in any calendar month who accumulates hazardous waste onsite for 180 days or less, or 270 days or <br />less if the generator transports the generator's own waste, or offers the generator's waste for transportation, over a <br />distance of 200 miles or more, for offsite treatment, storage, or disposal, is not a storage facility if all of the following <br />apply: <br />(1) The quantity of hazardous waste accumulated onsite never exceeds 6,000 kilograms. <br />(2) The generator complies with the requirements of 40 Code of Federal Regulations section 262.34(d), (e) and (f). <br />(3) The generator does not hold acutely hazardous waste or extremely hazardous waste in an amount greater than one <br />kilogram for more than 90 days. <br />CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 180 days in compliance <br />with Title 22 California Code of Regulations. Provide a corrective action statement and a copy of the disposal records <br />to the San Joaquin County Environmental Health Department (EHD) within 30 days. <br />Page 3 of 6 <br />
