SAN J O A g U I N Environmental Health Department <br /> CC LJ N T Y------- <br /> Permit By Rule Treatment Facility Inspection Report <br /> Facility Name: Facility Address: Date: <br /> METAL FINISHING SOLUTIONS-STOCKTON 1325 EL PINAL DR, STOCKTON August 31, 2020 <br /> Item# Remarks <br /> 104 CCR 67450.3(c)(1) Failed to submit an onsite annual hazardous waste treatment notification by January 1. <br /> OBSERVATION: This facility is treating hazardous waste but has not submitted the annual treatment notification <br /> information to the California Environmental Reporting System (CERS)by January 1 for the following years: 2019& <br /> 2020. The last CERS submittal was dated 9/26/2018. <br /> REGULATION GUIDANCE: The owner or operator of a fixed treatment unit(FTU)that treats hazardous waste shall <br /> submit in the California Environmental Reporting System (CERS)the following sections:the Business Activities <br /> Page,the Business Owner/Operator Page and the Onsite Hazardous Waste Treatment Notification-Facility page <br /> and subsections. The submittal shall be made by January 1 of each year following the first treatment of waste with <br /> the FTU, and by January 1 of each subsequent year. <br /> CORRECTIVE ACTION: Immediately submit the required annual Hazardous Waste Treatment notification in CERS <br /> for review by the San Joaquin County Environmental Health Department(EHD). Provide a corrective action <br /> statement and supporting documentation to the EHD within 30 days. <br /> This is a Class II violation. <br /> 107 CCR 67450.13(a)(2) Failed to annually adjust the closure cost estimate and certification of financial assurance. <br /> OBSERVATION: This facility is treating hazardous waste but has not submitted by March 1 an inflation adjusted <br /> written estimate of the cost of closing each fixed treatment unit(FTU)and financial assurance certification to the <br /> California Environmental Reporting System (CERS). The submittal to CERS for the following years: 2019 and 2020 <br /> has not been submitted in CERS. The last submittal was dated 9/26/2018. <br /> REGULATION GUIDANCE: The owner or operator of a fixed treatment unit(FTU)shall adjust the closure cost <br /> estimate to close each unit every year by March 1. The adjustment shall be made as specified in subsections(a)(2) <br /> (A)and (a)(2)(B)of this section, using an inflation factor derived from the annual Implicit Price Deflator for Gross <br /> National Product as published by the U.S. Department of Commerce in its Survey of Current Business.The inflation <br /> factor is the result of dividing the latest published annual Deflator by the Deflator of the previous year. <br /> (A)The first adjustment is made by multiplying the closure cost estimate by the inflation factor.The result is the <br /> adjusted closure cost estimate. <br /> (B)Subsequent adjustments are made by multiplying the latest adjusted closure cost estimate by the latest inflation <br /> factor. <br /> This adjusted closure cost estimate shall be submitted to the California Environmental Reporting System (CERS) <br /> website. <br /> California Health&Safety Code section 67450.13 describes the financial assurance mechanisms and exemptions. <br /> CORRECTIVE ACTION: Immediately submit the required adjusted closure cost estimate for each FTU and financial <br /> assurance certification to CERS for review by the San Joaquin County Environmental Health Department(EHD). <br /> Provide a corrective action statement and supporting documentation to the EHD within 30 days. <br /> This is a Class II violation. <br /> FA0024706 PR0543720 SCO01 08/31/2020 <br /> EHD 22-04 Rev.9/20/2019 Page 3 of 14 Permit By Rule Treatment Facility OIR <br /> 1868 E.
