The site historically drains southwesterly, <br /> as indicated on the attached 1980 aerial photo from O.I.D. During <br /> recent rains, the site drained to the south, much of the rainwater <br /> flowing into the pond on your property. It was observed that your <br /> pond the natural drainage swale flowing westerly under <br /> Hen Road. This natural occuring event continues to happen. <br /> pGcc/pi G S <br /> While natural runoff need not be mitigated or agreed to, you <br /> have constructed a 'man-made' pond that could interfere with the <br /> 'natural ' drainage of this site. Regarding your written concerns <br /> regarding waste discharges to your land from the proposed Poultry <br /> Operations, this is being addressed and regulated by the County <br /> and the State. During the initial review by such agencies, the <br /> southwest corner of said site was identified as needing measures <br /> to prevent discharge of waste products into said drainage courses. <br /> It is being considered that the southwest corner of the site be <br /> prohibited from being used as a manure spreading area, and that <br /> the existing ponds be designed to control waste discharges. <br /> It is reasonable that a new drainage agreement, for 'natural ' <br /> runoff from the site (rain, snow, etc.) be entered into with the <br /> new buyer of the project. Said new agreement should incorporate <br /> your concerns, and be agreeable and signed by both parties.
