The annual operating permit is not issued to the current operator and there is no written agreement between the person who was issued the permit and the operator to monitor the UST system. If a permit is issued to a person other than the operator of the tank, that person shall enter into a written agreement with the operator of the tank to monitor the UST system. Immediately submit a copy of this written agreement to the EHD. Alternatively, log into CERS, upload the written agreement, and submit for review by the EHD. This is a minor violation. 106 CCR 2632(d)(2), 2634(e) Failed to have an approved UST response plan. The response plan is not current and/or not approved by the EHD. The response plan was not signed and dated by the owner/operator. The response plan must be uploaded to the California Environmental Reporting System (CERS). Immediately log into CERS, upload the completed form, and submit for review by the EHD. Ensure a copy is available for inspection at any time. This is a minor violation. 121 CCR 2712(f) Failed to submit a written response within 30 days of receiving an inspection report. An inspection was last done on 8/21/18 and an inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted by 9/20/18. All of the information has not been received resulting in a non compliance status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken. Ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. This is a Class II violation. 209 CCR 2716(a-e) Failure to conduct the designated UST operator visual inspection at least once every 30 days. The designated operator failed to check and note all required items on the visual inspection reports. -The 03/11/19 inspection report did not include the date signed by the owner/operator. During the visual inspection, the designated operator shall check that all required testing and maintenance for the UST system have been completed and shall check all required items on the report. Ensure that designated operators performing visual inspections at this facility are including all of the required information on the reports. This is a minor violation.
