SETTLEMENT AGREEMENT - 2 - <br /> ADMINISTRATIVE <br /> 2 - <br /> ADMINISTRATIVE CIVIL LIABILITY COMPLAINT NO. R5-2005-0528 <br /> Technical Reports described below. If the Discharger fails to fully comply with this Agreement at <br /> any time, then within 30 days of the demand of the Executive Officer, the Discharger shall submit <br /> payment of$10,000; the suspended portion of the ACL Complaint. In addition,the Regional Board <br /> may take any administrative or judicial enforcement actions available, including reissuance of a <br /> complaint for administrative civil liability for the suspended portion of the ACL proposed in ACL <br /> Complaint No. R5-2005-0528. To comply with this Agreement, the following reports shall be <br /> submitted on-time: <br /> a. Self-monitoring monthly reports consistent with WDRs Order No. R5-2004-0035 (or <br /> replacement order) in the time period from January 2006 until January 2007. <br /> b. Self-monitoring quarterly reports consistent with WDRs Order No. R5-2004-0035 (or <br /> replacement order) in the time period from January 2006 until January 2007. <br /> c. Self-monitoring annual report prepared as the December 2006 monthly report consistent with <br /> WDRs Order No. R5-2004-0035 (or a replacement order). <br /> d. Submittal of the following technical reports on or before the dates specified; <br /> i. By 17 February 2006, submit a Groundwater Well Installation Report of Results that is <br /> consistent with Provision G.IS of WDRs Order No. R5-2004-0035. <br /> ii. By 28 February 2006, submit a Salinity Reduction Study that is consistent with Provision <br /> G.1.g of WDRs Order No. R5-2004-0035. <br /> iii. By 30 March 2006, submit an Abbreviated Report of Waste Discharge (RWD)presenting <br /> planned changes to the wastewater system. At a minimum,the Abbreviated RWD shall <br /> address the items listed in Attachment A to this Settlement Agreement. <br /> iv. By 30 March 2007, submit a Background Groundwater Quality Study Report that is <br /> consistent with Provision G.Lh of WDRs Order No. R5-2004-0035. <br /> 7. -In settling this matter, the Discharger does not admit to any of the findings of ACL Complaint <br /> No. R5-2005-0528, or that it has been or is in violation of its waste discharge requirements, the <br /> California Water Code, or any other federal, state, or local law or ordinance. <br /> 8. The Executive Officer has the authority to settle this matter in accordance with Water Code <br /> Section 13323 and Government Code Section 11415.60. <br /> 9. The Discharger has been informed of the rights provided by Water Code section 13323, subdivision <br /> (b), and hereby waives its right to a hearing before the California Regional Water Quality Control <br /> Board, Central Valley Region, within ninety (90) days of the date of issuance of the ACL Complaint. <br /> 10. The Discharger understands that payment in accordance with this Agreement is not a substitute for <br /> compliance with applicable laws, and that continuing violations of the type alleged in the Complaint <br /> may subject it to further enforcement, including additional civil liability. <br /> 11. This Agreement is severable; should any provision be found invalid the remainder shall remain in <br /> full force and effect. <br />
