CASE SUMMARY <br /> Flag City Chevron is a gasoline and diesel dispensing facility consisting of four <br /> underground storage tanks (USTs) and six dispensers. <br /> On July 23, 2008, Mr. Garrett Backus, Senior Registered Environmental Health <br /> Specialist (RENS), San Joaquin County Environmental Health Department (EHD), <br /> performed a routine UST inspection (Attachment 1) and witnessed the annual monitoring <br /> system certification, spill container testing, and leak detector testing. The diesel tank <br /> annular sensor failed and liquid that appeared to be diesel was found in the under <br /> dispenser containment sumps (UDCs) 5/6 and 9/10. The alarm light bulb on the <br /> monitoring panel was burned out and the audio alarm worked erratically. During a <br /> review of the facility's paperwork, Mr. Backus found that current financial responsibility <br /> document were not on file with the EHD and the Unified Program Consolidated Form <br /> (UPCF) — Facility, UPCF —Tank forms, and monitoring plan were not current. Also, a <br /> new designated operator was hired in January 2008 and the EHD was not notified. <br /> On July 23, 2008, Mr. Backus also performed a routine hazardous waste inspection <br /> (Attachment 2). Seven 55-gallon containers were found holding various amounts of <br /> hazardous waste. One of the containers had a blank "Hazardous Waste" label on it. <br /> Another had a "Hazardous Waste" label with an accumulation start date of 4/07. The <br /> remaining five containers were not labeled at all. During a review of the facility's <br /> paperwork, Mr. Backus found that the facility did not have a valid Environmental <br /> Protection Agency (EPA) Identification number to manage hazardous waste or a <br /> contingency plan. <br /> On July 24, 2008, permit application SR0054934 was submitted to replace the diesel <br /> UST annular sensor. Mr. Backus approved the permit the following day (Attachment 3). <br />
