Box 825 <br /> Victor, CA 95253 <br /> IYA TER CODE SECTION 13267 ORDER FOR REPORT, CHATFIELD WINERY, <br /> LODI, SAN JOAQUIN COUNTY <br /> On 23 August 2001, the Regional Board transmitted the following Water Code Section 13267 Order for <br /> Report to Mr. David Sproul of Chatfield Winery. The transmittal was sent by certified mail. The certified <br /> mail was unclaimed despite the first notice on 25 August 2001 and a second notice on 6 September 2001. <br /> Therefore, this letter is now being transmitted by a process server. <br /> On 14 August 2001, in response to a citizen complaint, staff inspected a wastewater spill site adjacent to <br /> the Mokelumne River. Staff discovered that this discharge was a continuing illegal discharge. The spill <br /> was the same site identified in an 8 May 2001 site inspection. During that inspection it was discovered <br /> that Chatfield Winery was discharging wastewater to the area illegally. In a letter dated 11 May 2001, <br /> Chatfield Winery was required to immediately cease discharge of the wastewater. In 25 May 2001 <br /> correspondence, Chatfield Winery informed the Board that there would be no discharge until proper <br /> permits were issued from regulatory agencies. <br /> During the 14 August 2001 site inspection, staff visited Chatfield Winery and discussed the wastewater <br /> handling procedures with employees. From visual observations, the winery was obviously in production <br /> and generating wastewater. The floor was wet from wash down water and employees were working <br /> cleaning wine bottles. When asked the status of the wastewater,winery employees declined to state where <br /> the wastewater was being discharged and referred staff to you. A second employee from your office,who <br /> was familiar with the wastewater storage issue, informed staff that piping was being installed to allow <br /> storage of wastewater in above ground tanks. However, the piping connections were not completed(see <br /> attached photograph). <br /> .Based on staff's 8 May 2001 and 14 August 2001 observations, Chatfield Winery is the source of an <br /> ongoing illegal discharge to an area adjacent to the Mokelumne River. Such a discharge is prohibited by <br /> the California Water Code and is not consistent with wastewater treatment/storage/disposal requirements <br /> of the Regional Board. Chatfield Winery must cease the illegal discharge of wastewater to land <br /> immediately. By 5 November 2001 Chatfield Winery shall submit a technical report documenting: <br /> a) that it has ceased the discharge of industrial wastewater to the area adjacent to the Mokelumne River <br /> and b) the new method of wastewater disposal. The report shall be signed under penalty of perjury and <br /> contain the following statement: <br /> California Environmental Protection Agency <br /> ra Recycled Paper <br /> The energy challenge facing California is real.
