Olivera <br /> PO Box 32126 <br /> San Jose CA 95152 <br /> Dear Mr. Olivera, <br /> I am a neighboring landowner to your parcel # 191-28-19 on <br /> Bowman Road on Lathrop. I have visited your poultry operation <br /> on several occasions in attempts to talk to you, usually after <br /> a wind shift in my direction. There is no delicate way to put <br /> this, your poultry operations create the most hellacious odors <br /> that travel for miles as the breezes blow. <br /> I made a recent visit there with Ed Simas, San Joaquin County <br /> Supervisor, to let him smell the smells and see the sights of <br /> the wastewater pond, chicken carcasses, etc .. <br /> In recent years there has been a lot of new technology in <br /> wastewater treatment. I have done my research, and am convinced <br /> that with a combination of oxygenation and enxyme additive, you <br /> could reduce odor emmissions by 95% . My trip recently to the <br /> ranch was to make you aware of this process, if you were not <br /> already informed. <br /> I will come to the point. There is a move afoot to emulate the <br /> successful prosecution of a similar facility in a nearby county, <br /> whereby a group of twenty nearby residents all sued the offending <br /> facility for being a public nuisance in small claims court. The <br /> plaintiffs were successful in obtaining twenty $5000.00 judgements <br /> against the farm. <br /> There are far more that twenty nearby residents who have suffered <br /> the odors produced by Hayre's, and now Jenkins and Olivera ranches. <br /> You could find yourself, without an attorney, defending your operation <br /> from the same technique used to close down crack houses in urban <br /> areas. <br /> You need to mitigate your offending practices now. I would like <br /> to discuss two items with you. 1. Outright purchase of your <br /> property at market value of the real estate; and 2 .
